What is a Trademark?

What is a Trademark?
A trademark is a word, phrase, symbol, design, or combination of words, phrases, symbols or designs, that identifies and distinguishes the source of the goods of one party from those of others.

What is a Service mark?
A service mark is the same as a trademark, except that it identifies and distinguishes a service instead of a product.

What are the benefits of Trademark Registration?
  • Constructive notice to the public of claim of ownership of the mark;
  • The ability to bring an action (sue someone) for infringment in federal court;
  • Use of US registration as a basis to obtain registration in foreign countries; and
  • The ability to prevent importation of infringing foreign goods.
